EULA
This End User License Agreement (“Agreement”) is a legal contract between you (“Licensee”, “you”, or “your”) and Martin Dudáš (“Licensor”, “we”, “us”, or “our”) governing your use of the audio samples, loops, presets, MIDI, and other sound content provided by Licensor (collectively, the “Samples”). By purchasing, downloading, installing, or using any Samples, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the Samples.
1. Grant of License
Subject to your compliance with this Agreement, Licensor grants you a non‑exclusive, non‑transferable, worldwide, royalty‑free license to:
1.1. Use the Samples in the creation of original musical compositions, productions, audiovisual works, podcasts, games, advertisements, and performances.
1.2. Release, distribute, sell, or otherwise monetize those original works that incorporate the Samples, including for commercial purposes.
1.3. Modify, edit, combine, alter, or process the Samples as part of your creative works.
This license does not transfer ownership of the Samples to you — you are granted only a limited license to use them as set out in this Agreement.
2. Restrictions
You may NOT:
2.1. Sell, sublicense, rent, lease, redistribute, share, or otherwise transfer the Samples in their original, unmodified form, or as part of a sample pack, sound bank, instrument library, plugin, preset pack, MIDI pack, or similar product.
2.2. Use the Samples to create or contribute to a competing product (e.g., another sample pack, sound library, preset collection, or audio database).
2.3. Use any portion of the Samples for the training, development, or improvement of artificial intelligence (AI) models, machine learning datasets, neural networks, or similar technologies.
2.4. Claim ownership, authorship, or copyright of the Samples themselves — you only own the rights to your original compositions that use the Samples.
2.5. Use the Samples in ways that violate applicable laws or infringe on the rights of others.
2.6. Combine or process the Samples to recreate isolated samples, loops, or derivative packs for redistribution.
3. Ownership
All rights, title, and interest in and to the Samples (including all copyrights and intellectual property rights) remain with Licensor and/or its licensors. This Agreement does not grant you any rights not expressly stated in this document.
4. Termination
This license is effective until terminated. Licensor may terminate this Agreement and your rights under it immediately if you fail to comply with any provision of this Agreement. Upon termination, you must cease all use of the Samples and delete all copies in your possession or control.
5. Warranty Disclaimer
The Samples are provided “as‑is” and without warranties of any kind — express or implied. Licensor does not warrant that the Samples will meet your specific requirements or that they are free from defects or infringement claims.
6. Limitation of Liability
To the maximum extent permitted by law, Licensor shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Samples, even if advised of the possibility of such damages.
7. Governing Law
This Agreement and any disputes arising out of it shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of laws principles. Any legal action shall be brought exclusively in the courts of the Slovak Republic.
8. Changes to this Agreement
Licensor reserves the right to modify this Agreement at any time. Continued use of the Samples after changes have been made constitutes acceptance of the revised terms.
